Frequently asked questions
When do I get overtime?
Under the federal Fair Labor Standards Act, non-exempt employees must be paid at least 1.5 times their regular rate for every hour over 40 in a workweek. Some states, like California, also require overtime after 8 hours in a day.
What is double time?
Double time is twice the regular rate. It is not required by federal law, but some states require it (California after 12 hours in a day) and some employers pay it for holidays or long shifts.
Is overtime taxed more?
No. Overtime is taxed like the rest of your pay; it only looks higher because a bigger paycheck is withheld at a higher rate. For 2025 to 2028 there is also a federal deduction for part of qualified overtime pay.
